Congress has the power to enact this legislation pursuant to the following: The Necessary and Proper Clause (Article I, Section 8, Clause 18) and The Commerce Clause (Article I, Section 8, Clause 3 of the U.S. Constitution) By Ms. STEFANIK: H.R. 7894. Congress has the power to enact this legislation pursuant to the following: Congress has the power to enact this legislation pursuant to Article I, Section 8, Clause 1 of the Constitution of the United States, which grants Congress the authority to provide for the general welfare of the United States, and Article I, Section 8, Clause 18, which authorizes Congress to make all laws necessary and proper for carrying into execution the foregoing powers. Congress has the power to enact this legislation pursuant to the following: Article I, Section 8, Clause 18 of the Constitution of the United States, which provides: ``The Congress shall have Power . . . To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.'': This legislation also implements and protects the constitutional guarantees contained in the Fourth Amendment to the Constitution of the United States, which provides: ``The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.''
