EXEMPTION OF ARTICLES OF FOOD FROM CERTAIN COUNTRIES FROM CERTAIN DUTIES. (a) In General.--A duty imposed pursuant to section 122 of the Trade Act of 1974 (19 U.S.C. 2132) shall not apply with respect to an article of food imported into the United States from a country to which the United States has extended normal trade relations. (b) Retroactive Application for Certain Liquidations and Reliquidations.--Notwithstanding section 514 of the Tariff Act of 1930 (19 U.S.C. 1514) or any other provision of law, in the case of an entry of an article of food exempt under subsection (a) that was made before the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection shall liquidate or reliquidate the entry at the rate of duty applicable to the article in the absence of any duty imposed pursuant to section 122 of the Trade Act of 1974 (19 U.S.C. 2132). (c) Prohibition on Imposition of Certain Duties.--On or after the date of the enactment of this Act, the President may not impose any duty on an article of food imported into the United States from a country to which the United States has extended normal trade relations, unless such duty was enacted pursuant to-- (1) a joint resolution or an Act of Congress approving such duty; (2) section 201 or 301 of the Trade Act of 1974 (19 U.S.C. 2251 and 2411); (3) section 232 of the Trade Expansion Act of 1962 (19 U.S.C. 1862); or (4) title VII of the Tariff Act of 1930 (19 U.S.C. 1671 et seq.). (d) Article of Food Defined.--In this section, the term ``article of food'' means-- (1) food for use; (2) products chiefly used as food for animals or as ingredients in such food; (3) agricultural commodities (as defined in section 102 of the Agricultural Trade Act of 1978 (7 U.S.C. 5602)); (4) articles used for packaging and containing articles described in paragraph (1), (2), or (3); and (5) seeds, fertilizers, manures, and agro-chemicals. ______
